The runner-up in the Saint John Harbour riding is alleging several voter irregularities during the provincial election.
Progressive Conservative candidate Barry Ogden lost to Liberal candidate Gerry Lowe by 10 votes in the September 24 vote.
But documents filed with the Court of Queen’s Bench by Ogden and his campaign manager, Peter Josselyn, appear to call the outcome into question.
Based on the statement of elector forms, they allege more than one vote appears to have been cast under the same unique Combined Poll Number and Elector Number on about 40 occasions.
Ogden and Josselyn also claim the information of two deceased people appears to have been used and one person voted based on residing at a vacant address.
None of the allegations have been proven in court.
According to the documents, Ogden and Josselyn intend to seek the release of Elections New Brunswick documents and an order to set aside Lowe’s election and declare his seat vacant.
The case is scheduled to return to court on Monday afternoon.
