A court challenge involving September’s election outcome in Saint John Harbour continues.
Another pre-hearing conference was held in the Court of Queen’s Bench on Friday.
Liberal Gerry Lowe defeated Progressive Conservative Barry Ogden by 10 votes. But the PCs want the results overturned, alleging dozens of voting irregularities.
Justice Hugh McLellan went through a previously submitted affidavit from PC riding association president David Keirstead, striking out items not relevant to the case.
This is quite a tedious process. Justice is going through the affidavit nearly paragraph-by-paragraph. Lawyers for Ogden, Lowe and Elections NB are allowed to make submissions before justice makes his decision.

McLellan also heard arguments on a motion by Lowe’s lawyer, who wanted the affidavits and transcripts of municipal returning officer Patti Nason to be accepted into evidence.
The judge ruled in favour of the motion and adjourned the case until next Thursday.
