The court action involving the results of the provincial election in Saint John Harbour will carry on.
A motion by lawyers representing Elections New Brunswick to have lawyers representing Barry Ogden removed from the case was dismissed by Justice Hugh McLellan.
McLellan dismisses the motion to remove VanBuskirk and company from the motion.

McLellan also ruled a document which ENB lawyer Fred McElman says was leaked to Ogden’s team does not have to be released right now.
Outside the Saint John Law Courts building, Gerry Lowe said he agrees this situation places a cloud over him.
“If you read social media, they think that we did something. We didn’t do nothing. If someone voted twice, they never voted twice at our direction.”
Lowe says he, Barry and their teams worked hard on the campaign.
“The end result is what it is. It’s a local thing. I think the judge ruled right about everything. I’m happy.”

Referring to the confusion, Justice McLellan calls the case “a tangle of trouble that needs sunlight to disperse the cloud”.
Chief Electoral Officer Kim Poffenroth releasing a statement saying Elections New Brunswick is as eager as all other parties to have this matter resolved in a timely and transparent fashion.
She says they are ready to prepare a new affidavit with supporting documents as it relates to the information requested by Justice McLellan.
